These Terms of Service ("Terms") govern your use of the BetterFlare platform and related services ("Service") provided by BetterFlare OÜ ("we", "us"). By using the Service, you agree to these Terms.
1. Acceptance
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of service
BetterFlare provides a flight training management platform for instructors, students, and organizations. We reserve the right to modify or discontinue the Service with reasonable notice.
3. Accounts and use
You must provide accurate information and keep your account secure. You are responsible for all activity under your account. You must use the Service in compliance with applicable laws and not misuse or harm the Service or others.
3.1 Prohibited uses
In addition to the general obligations above, you may not:
- Use the Service as a replacement for any paper logbook, official training record, or documentation required by a national aviation authority (including, without limitation, the FAA and EASA);
- Submit false, misleading, or fraudulent training records, flight data, or certification information through the Service;
- Use the Service in any manner that violates applicable aviation regulations or safety requirements.
4. Intellectual property
The Service, including software, design, and content (excluding your data), is owned by BetterFlare OÜ or its licensors. You retain ownership of your data; you grant us a license to use it to provide the Service.
5. Limitation of liability and warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available". We are not liable for indirect, incidental, or consequential damages, or for loss of data or profits. Our total liability is limited to the amount you paid us in the twelve months before the claim.
We make no warranty that data stored in or generated by the Service meets the record-keeping requirements of the FAA, EASA, or any other aviation authority. We do not warrant that the Service will be uninterrupted, error-free, or free from data loss. You are solely responsible for maintaining independent backups of any data you consider critical.
6. Safety disclaimer
The Service is a training management tool and is not a substitute for official training records, pilot logbooks, or any documentation required by aviation regulatory authorities, including but not limited to the FAA and EASA. All flight data, training records, and progress information presented through the Service must be independently verified against official sources before being relied upon for any regulatory, operational, or safety-related purpose.
BetterFlare OÜ is not responsible for any regulatory non-compliance, safety incident, or adverse outcome arising from reliance on data provided by or through the Service.
7. Indemnification
You agree to indemnify, defend, and hold harmless BetterFlare OÜ, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) any aviation-related decision made in reliance on information obtained through the Service; (c) your violation of these Terms; or (d) your violation of any applicable law or regulation.
8. Subscriptions and refunds
BetterFlare offers a free plan that allows you to explore the Service before committing to a paid subscription. Paid plans are billed on a monthly basis and can be cancelled at any time — your access will continue until the end of the current billing period.
Refund policy. If you are not satisfied with a paid subscription, you may request a full refund within 14 days of your purchase date — no questions asked. To request a refund, contact us at contact@betterflare.aero. After the 14-day refund window has passed, no refunds will be issued for any partial or unused subscription periods.
9. Service availability
We strive to maintain reasonable availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime where practicable.
We perform regular backups of platform data; however, we do not guarantee that backups will be available for individual account restoration. You are responsible for exporting and independently retaining copies of any data you consider essential. Data retention following account termination is subject to our Privacy Policy and applicable law.
10. Third-party integrations
The Service may contain links to, or integrations with, third-party aviation tools, services, or resources. These third-party offerings are provided for convenience only and are not under the control of BetterFlare OÜ. We make no representations or warranties regarding the accuracy, availability, or suitability of any third-party service. Your use of any third-party service is at your own risk and subject to that provider's terms and conditions.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access for breach of these Terms or for other reasons with notice where required.
We reserve the right to suspend or terminate your account immediately and without prior notice if we reasonably determine that your use of the Service poses a safety risk, violates applicable aviation regulations, or otherwise endangers the safety of any person or aircraft.
12. Governing law
These Terms are governed by the laws of Estonia. Disputes shall be resolved in the courts of Estonia.
